In the case of advanced legal technologies, a key, but often overlooked, question is simply: Did it work? At HBC, we have over 20 years' experience in designing and executing evaluations to answer just that question. Recognizing that, to be meaningful, evaluations must be tailored to use case, we collaborate with our clients in designing (and executing) tests that will, in a manner that is efficient, scientifically sound, practically viable, and tailored to circumstance, answer the question at hand. We are always ready to document and defend the design, execution, and results of our evaluations.

ESI protocols, properly designed and articulated, can serve the interests of all parties to discovery. For the requesting party, a protocol can serve as a mechanism for establishing trust that a production is a reasonably complete and accurate response to a request. For the responding party, a protocol can put guardrails on the discovery proceedings, affording predictability, protecting autonomy, and shielding from unnecessary motion practice. HBC, with its experience writing both matter-specific and generic protocols, answers its clients' needs with protocols that, with a sharp focus on validation of results, are both efficient and meaningful.

Engaging in an e-discovery meet-and-confer without the appropriate technical expertise can be an anxious affair of uncertain outcome. With the appropriate expertise, however, a meet-and-confer becomes an opportunity to realize a client's goals in a predictable fashion. HBC has experience supplying both requesting and responding parties with the guidance needed to engage in meet-and-confers in a confident and effective manner.  For requesting parties, we assist in identifying and prioritizing the questions that need to be answered in order to gain a clear and insightful view of the completeness of a production. For responding parties, we assist in deciding what information about a review process should and shouldn't be disclosed and in defending those decisions.

Addressing the factual issues raised in investigations and litigation often requires the collection and analysis of data. The effective interrogation of data requires formulating the operative question in a way that lends itself to an empirical answer, designing an exercise that will gather the requisite data, conducting sound statistical analysis of the collected data, and summarizing the results in a clear and impactful manner. At HBC, we have wide experience in finding ways to arrive at empirical answers to seemingly intractable questions and we bring that experience to bear in helping clients get the most out of the data to which they have access.

Dr. Hedin is a frequent speaker and writer on e-discovery, measurement and validation legal technologies, and mechanisms to ensure the responsible use of AI-enabled systems.
